Algemene Voorwaarden van Just Lene Photography

Just Lene Photography is gevestigd in België en geregistreerd onder het ondernemings- en btw-nummer: BE1005.226.242. In deze voorwaarden wordt met "de Fotograaf" Just Lene Photography bedoeld, en met "de Klant" de persoon of het bedrijf dat een fotoshoot boekt. Deze algemene voorwaarden zijn van toepassing op alle offertes, boekingen en overeenkomsten, tenzij we schriftelijk samen iets anders hebben afgesproken.
BOEKINGEN, OVEREENKOMSTEN & RECHT VAN WEIGERING
Boekingen en overeenkomsten
Een boeking is pas officieel en juridisch bindend zodra de Fotograaf een schriftelijke boekingsbevestiging via e-mail heeft verzonden. Door het bevestigen van een boeking, het accepteren van een offerte of het deelnemen aan de fotoshoot, verklaart de Klant zich uitdrukkelijk en onvoorwaardelijk akkoord met deze Algemene Voorwaarden.
Recht om opdrachten te weigeren of te annuleren
De Fotograaf behoudt het recht om te allen tijde opdrachten te weigeren of een reeds bevestigde boeking te annuleren wanneer de Klant niet voldoet aan de gevraagde voorbereidingen, of na het verkrijgen van nieuwe informatie die het voor de Fotograaf onmogelijk of onverantwoord maakt om de fotosessie uit te voeren.
TARIEVEN & BETALING
Prijzen en betalingstermijn
Alle genoemde prijzen zijn in Euro (€). Prijzen zijn inclusief of exclusief btw, afhankelijk van wat er in de offerte of boekingsbevestiging staat. Na de fotoshoot ontvangt de Klant de factuur digitaal via e-mail. Deze factuur dient binnen 14 kalenderdagen na de factuurdatum te worden betaald. Het is uitsluitend mogelijk om de fotosessie te betalen per bankoverschrijving. Het is ook mogelijk om de fotosessie ter plaatse te betalen aan de hand van een digitale QR-code. De definitieve, bewerkte digitale foto's in hoge resolutie worden pas aan de Klant geleverd nadat het volledige factuurbedrag is ontvangen op de bankrekening van de Fotograaf.
Prijswijzigingen
Prijswijzigingen zijn mogelijk. De prijs die de klant ontvangt op de dag van de officiële boeking blijft steeds ongewijzigd voor die specifieke sessie, ongeacht eventuele latere prijsstijgingen.
Belangrijke voorwaarde voor levering
De definitieve, bewerkte digitale foto's in hoge resolutie worden pas aan de Klant geleverd nadat het volledige factuurbedrag is ontvangen op de bankrekening van de Fotograaf. Bij niet-betaling binnen de termijn van 14 dagen is de Klant van rechtswege en zonder ingebrekestelling een nalatigheidsintrest verschuldigd van 10% per jaar, evenals een forfaitaire schadevergoeding van 10% op het factuurbedrag met een minimum van €40.
DE ONLINE GALERIJ, DE AFGELEVERDE BEELDEN & LEVERINGSTERMIJN
Aantal afgeleverde foto's
Het aantal foto's dat de Klant na afloop ontvangt, is afhankelijk van een aantal factoren (zoals de weersomstandigheden, de medewerking van de deelnemers en de dynamiek van de sessie). Het exacte aantal kan moeilijk vooraf bepaald worden, maar de Klant krijgt steeds een indicatie van het aantal foto's aan de hand van een gegarandeerd minimum (zoals vermeld in de boekingsbevestiging of het gekozen pakket). Het aantal afgeleverde foto's kan dus verschillen tussen fotosessies onderling.
Geldigheid van de downloadlink (galerij) en bewaring
Het downloaden van de foto's in hoge resolutie kan met een persoonlijke code, die opnieuw enkel met de Klant gedeeld wordt. Deze downloadfunctie wordt geactiveerd zodra het volledige factuurbedrag is ontvangen op de bankrekening van de Fotograaf.
De online galerij en de downloadlink blijven 30 kalenderdagen beschikbaar. De Klant is zelf verantwoordelijk voor het tijdig downloaden en veilig opslaan van de foto's op de eigen apparatuur binnen deze periode. Na deze 30 dagen is de Fotograaf niet langer verplicht om de digitale bestanden te bewaren of te archiveren.
Selectie en leveringstermijn van de foto's
De Fotograaf maakt een artistieke selectie van de beste beelden van de fotoshoot. Onbewerkte originele bestanden (RAW-formaten) of niet-geselecteerde foto's worden onder geen enkele voorwaarde aan de Klant geleverd.
2 weken (voor shoots van maximaal een uur) of 1 maand (voor shoots langer dan een uur) na afloop van de fotosessie ontvangt de Klant een beveiligde online galerij met de afgewerkte beelden. Toegang tot deze online galerij wordt verkregen aan de hand van een unieke toegangscode die enkel met de Klant gedeeld wordt.
REGELING BIJ ANNULERING, NO-SHOWS & TE LAAT KOMEN
Annulering door de Klant
Annuleringen moeten altijd schriftelijk via e-mail worden doorgegeven. Bij annulering tot 7 kalenderdagen voor de geplande fotosessie wordt 40% van het totale bedrag van de shoot in rekening gebracht ter compensatie van de gereserveerde datum en de administratieve voorbereiding. Fotosessies die minder dan 7 kalenderdagen op voorhand worden geannuleerd, worden alsnog volledig (voor 100% van het totale bedrag) in rekening gebracht. De Klant kan een fotosessie wel kosteloos éénmalig verplaatsen naar een nieuwe datum indien deze op de originele datum onvoorzien verhinderd is.
No-show
Indien de Klant zonder voorafgaande schriftelijke verwittiging niet verschijnt op de afgesproken locatie en tijdstip (een zogenaamde 'no-show'), wordt de fotoshoot onmiddellijk geannuleerd en wordt 100% van het totale bedrag, vermeerderd met eventuele gemaakte verplaatsingskosten, in rekening gebracht.
Slecht weer bij outdoorshoots
In het geval van hevige regen, storm of andere extreme weersomstandigheden die kwalitatieve buitenfotografie onmogelijk maken, heeft de Fotograaf het exclusieve recht om te beslissen de shoot kosteloos te verplaatsen naar een nieuwe datum.
Annulering en overmacht door de Fotograaf
Bij plotselinge ziekte, een ongeval of onvoorziene technische overmacht aan de zijde van de Fotograaf, wordt de Klant onmiddellijk op de hoogte gesteld. De shoot wordt dan verplaatst naar een onderling overeengekomen datum. Indien er echt geen nieuwe datum gevonden kan worden, wordt de overeenkomst ontbonden en worden eventueel betaalde bedragen volledig teruggestort. De Fotograaf kan niet aansprakelijk worden gesteld voor verdere schade of kosten van derden.
Te laat komen op de shoot
De fotoshoot heeft een vaste duur zoals afgesproken in de boekingsbevestiging. Indien de Klant te laat arriveert, wordt deze tijd in mindering gebracht op de totale duur van de shoot. De fotoshoot eindigt nog steeds op het oorspronkelijk afgesproken tijdstip en de prijs blijft ongewijzigd.
AUTEURSRECHT, BEWERKINGSVERBOD (AI) & PRIVACY
Auteursrecht en persoonlijk gebruik
Just Lene Photography blijft de enige en exclusieve juridische eigenaar van het auteursrecht van alle foto's die tijdens de sessie worden gemaakt, conform de Belgische en internationale wetgeving. Na volledige betaling ontvangt de Klant een licentie voor strikt persoonlijk gebruik. Dit omvat het afdrukken van de foto's voor privégebruik en het delen op persoonlijke, niet-commerciële socialmediaprofielen.
Commercieel gebruik en bewerkingsverbod
Het is de Klant strikt verboden om de foto's voor commerciële doeleinden te gebruiken, door te verkopen aan derden, of in te sturen voor wedstrijden zonder voorafgaande schriftelijke toestemming van de Fotograaf. Het is de Klant ook niet toegestaan om de geleverde definitieve foto's zelf aan te passen, bij te snijden, opnieuw te bewerken of er digitale filters (zoals Instagram- of VSCO-filters) over te plaatsen. Dit verbod geldt uitdrukkelijk ook voor het aanpassen, uitbreiden of bewerken van de foto's met behulp van kunstmatige intelligentie (AI-tools, generatieve AI of ingebouwde AI-filters), aangezien dit het artistieke werk van de Fotograaf aantast.
Promotioneel gebruik en jouw privacy
Door het boeken van een fotoshoot verleent de Klant de Fotograaf toestemming om een selectie van de gemaakte beelden te gebruiken voor promotionele doeleinden, waaronder de website van de Fotograaf, het online portfolio, socialmediakanalen en gedrukt marketingmateriaal. Indien de Klant de foto's volledig privé wenst te houden (bijvoorbeeld vanwege privacyredenen rondom minderjarigen), dient de Klant de Fotograaf hier vóór de fotoshoot schriftelijk van op de hoogte te stellen. In dat geval wordt de privacy volledig gerespecteerd en worden er geen beelden gepubliceerd.
Artistieke stijl en klachten
De Klant verklaart bekend te zijn met de fotografische stijl en nabewerking van Just Lene Photography. De Fotograaf bewerkt de foto's naar eigen artistiek inzicht. Klachten over de artistieke stijl of gemaakte bewerkingskeuzes zijn geen geldige grond voor korting, terugbetaling of een herrekening van de fotoshoot. Technische klachten over de geleverde bestanden dienen binnen 7 kalenderdagen na levering schriftelijk te worden gemeld. Na deze periode wordt de levering als volledig geaccepteerd beschouwd.
CADEAUBONNEN, AANSPRAKELIJKHEID & RECHTBANK
Aansprakelijkheid tijdens de shoot
De Fotograaf kan niet aansprakelijk worden gesteld voor enig lichamelijk letsel, ongevallen, materiële schade of diefstal die plaatsvinden tijdens de fotoshoot op locatie, tenzij er sprake is van grove nalatigheid of opzettelijk wangedrag door de Fotograaf. De totale financiële aansprakelijkheid van de Fotograaf voor eventuele claims of technisch dataverlies is te allen tijde strikt beperkt tot het maximale bedrag dat de Klant voor de specifieke fotoshoot heeft betaald.
Toepasselijk recht
Op alle rechtsbetrekkingen tussen Just Lene Photography en de Klant is uitsluitend het Belgisch Recht van toepassing. Eventuele geschillen die niet in onderling overleg kunnen worden opgelost, zullen uitsluitend worden voorgelegd aan de bevoegde rechtbanken van het arrondissement waar de onderneming van de Fotograaf gevestigd is.
Cadeaubonnen
Geldigheid en voorwaarden
Cadeaubonnen hebben een strikte geldigheidsduur van 1 jaar na de datum van uitgifte. Na verloop van deze termijn kan de cadeaubon niet meer gebruikt worden, tenzij de Klant akkoord gaat met het toepassen van eventuele tussentijdse prijsstijgingen om de bon alsnog te valideren.
Terugbetaling en overwaarde van cadeaubonnen
Cadeaubonnen worden in geen enkel geval terugbetaald na uitgifte. Indien de waarde van de cadeaubon hoger is dan de gekozen fotosessie, zal de eventuele overwaarde niet in cash of via overschrijving worden terugbetaald; de overwaarde blijft in dat geval staan als tegoed voor een volgende sessie binnen de oorspronkelijke geldigheidsduur.
Inwisselen en doorgeven van cadeaubonnen
Cadeaubonnen kunnen geldig zijn voor een volledige specifieke fotosessie, of dragen een bepaalde vaste geldsom. Ze kunnen altijd worden ingeruild voor een duurdere fotosessie na het betalen van het aanvullende bedrag van de gekozen sessie. Cadeaubonnen zijn niet persoonsgebonden en mogen worden doorgegeven aan derden, mits de originele geldigheidsduur gerespecteerd wordt.
Terms & Conditions - Just Lene Photography
Just Lene Photography is established in Belgium and registered under enterprise and VAT number: BE1005.226.242. In these terms and conditions, "the Photographer" refers to Just Lene Photography, and "the Client" refers to the person or company booking a photoshoot. These general terms and conditions apply to all quotes, bookings, and agreements, unless explicitly agreed otherwise in writing.
BOOKINGS, AGREEMENTS & RIGHT OF REFUSAL
Bookings and agreements
A booking is considered official and legally binding only after the Photographer has issued a written booking confirmation via email. By confirming a booking, accepting a quote, or participating in the photoshoot, the Client explicitly and unconditionally agrees to these General Terms and Conditions.
Right to refuse or cancel assignments
The Photographer reserves the right to refuse assignments or cancel an already confirmed booking at any time if the Client does not comply with the requested preparations, or upon obtaining new information that makes it impossible or irresponsible for the Photographer to execute the photoshoot.
RATES & PAYMENT
Prices and payment terms
All mentioned prices are in Euros (€). Prices include or exclude VAT, depending on what is specified in the quote or booking confirmation. After the photoshoot, the Client will receive the invoice digitally via email. This invoice must be paid within 14 calendar days of the invoice date. Payment for the photoshoot is exclusively possible via bank transfer. The final, edited digital photos in high resolution will only be delivered to the Client after the full invoice amount has been received in the Photographer's bank account.
Price changes
Price changes are possible. The price the client receives on the day of the official booking remains unchanged for that specific session, regardless of any subsequent price increases.
Important condition for delivery

In the event of non-payment within the 14-day term, the Client is legally and without prior notice of default liable for a late payment interest of 10% per annum, as well as a flat-rate compensation fee of 10% of the invoice amount, with a minimum of €40.
THE ONLINE GALLERY, DELIVERED IMAGES & DELIVERY TIME
Number of delivered photos
The number of photos the Client receives after the session depends on a number of factors (such as weather conditions, the cooperation of the participants, and the dynamics of the session). The exact number is difficult to determine in advance, but the Client will always receive an indication based on a guaranteed minimum (as stated in the booking confirmation or the chosen package). The number of delivered photos may therefore vary between individual sessions.
Validity of the download link (gallery) and storage
The final high-resolution photos can be downloaded using a personal code, which is once again shared exclusively with the Client. This download function will be activated as soon as the full invoice amount has been received in the Photographer's bank account.
The online gallery and the download link will remain available for 30 calendar days. The Client is solely responsible for downloading and safely storing the photos on their own equipment within this period. After these 30 days, the Photographer is no longer required to store or archive the digital files.
Selection and delivery time of the photos
The Photographer makes an artistic selection of the best images from the photoshoot. Unedited original files (RAW formats) or unselected photos will never be delivered to the Client under any circumstances.
2 weeks (for shoots of up to one hour) or 1 month (for shoots longer than one hour) after the photoshoot, the Client will receive a secure online gallery containing the finished images. Access to this online gallery is obtained using a unique access code shared exclusively with the Client.
CANCELLATION POLICY, NO-SHOWS & LATE ARRIVALS
Cancellation by the Client
Cancellations must always be submitted in writing via email. In the event of a cancellation up to 7 calendar days before the scheduled photoshoot, 40% of the total amount of the shoot will be charged to compensate for the reserved date and administrative preparation. Photoshoots cancelled less than 7 calendar days in advance will be charged in full (100% of the total amount). The Client may reschedule the photoshoot once free of charge to a new date if they are unexpectedly unavailable on the original date.
No-show
If the Client fails to appear at the agreed location and time without prior written notice (a so-called 'no-show'), the photoshoot will be cancelled immediately and 100% of the total amount, plus any travel expenses incurred, will be charged.
Bad weather for outdoor shoots
In the event of heavy rain, storms, or other extreme weather conditions that make high-quality outdoor photography impossible, the Photographer has the exclusive right to decide to reschedule the shoot free of charge to a new date.
Cancellation and force majeure by the Photographer
In the event of sudden illness, an accident, or unforeseen technical force majeure on the part of the Photographer, the Client will be notified immediately. The shoot will then be rescheduled to a mutually agreed date. If no new date can possibly be found, the agreement will be dissolved and any amounts already paid will be fully refunded. The Photographer cannot be held liable for any further damages or third-party costs.
Arriving late to the shoot
The photoshoot has a fixed duration as agreed in the booking confirmation. If the Client arrives late, this time will be deducted from the total duration of the shoot. The photoshoot will still end at the originally scheduled time, and the price remains unchanged.
COPYRIGHT, EDITING RESTRICTIONS (AI) & PRIVACY
Copyright and personal use
Just Lene Photography remains the sole and exclusive legal owner of the copyright of all photos taken during the session, in accordance with Belgian and international copyright laws. Upon full payment, the Client receives a license for strictly personal use. This includes printing the photos for private use and sharing them on personal, non-commercial social media profiles.
Commercial use and editing restrictions
The Client is strictly prohibited from using the photos for commercial purposes, reselling them to third parties, or submitting them to competitions without prior written consent from the Photographer. The Client is also not allowed to modify, crop, re-edit, or apply digital filters (such as Instagram or VSCO filters) to the delivered final photos. This prohibition expressly applies to modifying, expanding, or editing the photos using artificial intelligence (AI tools, generative AI, or built-in AI filters), as this affects the artistic work of the Photographer.
Promotional use and your privacy
By booking a photoshoot, the Client grants the Photographer permission to use a selection of the captured images for promotional purposes, including the Photographer's website, online portfolio, social media channels, and printed marketing materials. If the Client wishes to keep the photos completely private (for example, due to privacy reasons regarding minors), the Client must inform the Photographer in writing prior to the photoshoot. In that case, privacy will be fully respected and no images will be published.
Artistic style and complaints
The Client declares to be familiar with the photographic style and post-processing of Just Lene Photography. The Photographer edits the photos according to their own artistic judgment. Complaints regarding the artistic style or chosen editing choices are not valid grounds for discounts, refunds, or a re-evaluation of the photoshoot. Technical complaints regarding the delivered files must be reported in writing within 7 calendar days after delivery. After this period, the delivery is considered fully accepted.
GIFT VOUCHERS, LIABILITY & JURISDICTION
Liability during the shoot
The Photographer cannot be held liable for any personal injury, accidents, material damage, or theft occurring during the photoshoot on location, unless caused by gross negligence or willful misconduct by the Photographer. The total financial liability of the Photographer for any claims or technical data loss is at all times strictly limited to the maximum amount paid by the Client for the specific photoshoot.
Applicable law
All legal relationships between Just Lene Photography and the Client are governed exclusively by Belgian Law. Any disputes that cannot be resolved through mutual consultation shall be submitted exclusively to the competent courts of the judicial district where the Photographer’s business is registered.
Gift vouchers
Validity and conditions
Gift vouchers have a strict validity period of 1 year from the date of issue. After this period, the gift voucher can no longer be used, unless the Client agrees to apply any interim price increases to validate the voucher.
Refunds and remaining value of gift vouchers
Gift vouchers are non-refundable under any circumstances after issue. If the value of the gift voucher is higher than the chosen photoshoot, any remaining value will not be refunded in cash or via bank transfer; in that case, the remaining value will remain as a credit for a subsequent session within the original validity period.
Redeeming and transferring gift vouchers
Gift vouchers can be valid for a complete, specific photoshoot, or carry a certain fixed monetary value. They can always be exchanged for a more expensive photoshoot after paying the additional amount of the chosen session. Gift vouchers are not person-specific and may be transferred to third parties, provided that the original validity period is respected.
